BlueGuard Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the services provided by BlueGuard ("BlueGuard," "we," "us," or "our"). By enrolling in, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Description of Services

BlueGuard provides software-based water usage monitoring, leak detection analytics, and alert services using available utility and meter data. Certain subscriptions or programs may include limited plumbing repair services as described in Section 7.

3. Authorized Agent Designation

By enrolling, you authorize BlueGuard to act as your authorized agent for the limited purpose of accessing water utility usage and meter data to provide monitoring, leak detection, alerts, and loss-prevention services. This authorization does not grant BlueGuard authority to modify utility account terms, billing information, or service settings.

4. Communications & Alert Authorization

4.1 Consent to Communications

By enrolling in the Services, you expressly consent to receive communications from BlueGuard, including communications delivered via:

4.2 Purpose of Communications

You authorize BlueGuard to contact you for purposes including, but not limited to:

Communications may occur at any time, including outside standard business hours, where reasonably necessary to mitigate potential water damage.

4.3 Emergency & Time-Sensitive Contact

You acknowledge and agree that time-sensitive communications are critical to the Services and that BlueGuard may attempt to contact you multiple times and through multiple channels if a potential leak or abnormal condition is detected.

Failure to respond to alerts or communications may limit BlueGuard's ability to mitigate loss or coordinate repairs.

4.4 Telephone Consumer Protection Act (TCPA) Consent

You expressly consent, for purposes of the Telephone Consumer Protection Act (TCPA) and similar state laws, to receive calls and messages (including autodialed and prerecorded communications) from BlueGuard at the telephone numbers you provide.

You consent to receive service-related emails from BlueGuard. You may opt out of non-essential emails, but service, alert, and account-related emails are mandatory for proper operation of the Services.

4.6 Accuracy of Contact Information

You acknowledge that water leaks and plumbing failures may occur regardless of monitoring services. You assume all risks associated with property ownership, plumbing systems, and water usage.

8. Repair Services (Limited Benefit; Strict Scope)

8.1 Repair Benefit Overview

Certain BlueGuard subscriptions or programs may include plumbing repair services at BlueGuard's expense (the "Repair Benefit"). The Repair Benefit, where offered, is voluntary, limited, and subject to all conditions below.

8.2 Maximum Repair Amount (Hard Dollar Cap)

BlueGuard's total financial responsibility for any covered repair shall not exceed a maximum dollar amount per covered incident (the "Repair Cap"), as specified in the applicable subscription details, program materials, or carrier-sponsored agreement.

The Repair Cap includes all labor, materials, parts, diagnostic work, and access-related work performed in connection with the covered repair.

Once the Repair Cap is reached, BlueGuard has no further obligation, and any additional costs shall be the sole responsibility of the property owner.

8.3 Covered Repairs (Strict Leak-Stoppage Scope)

The Repair Benefit applies only to the repair of a confirmed active leak originating from an internal pressurized potable water supply line located within the structure.

Covered repair work is strictly limited to the work reasonably necessary to:

Covered repairs may include replacement of ancillary plumbing components directly involved in the leak, solely to the extent necessary to stop the active leak and restore water service.

Covered repairs also include repair or replacement of toilet components (including fill valves, flappers, supply lines, and shut-off valves) when the failure is detected through BlueGuard's monitoring system. This coverage is limited to the components necessary to stop the detected water loss and does not include replacement of the toilet fixture itself.

Except as expressly provided above, covered repairs do not include replacement of fixtures, appliances, or end-use devices, even if such items are connected to the leaking line.

If permanent repair is not feasible within the applicable Repair Cap, BlueGuard may perform temporary or partial repairs sufficient to stop active water flow and mitigate damage, with no obligation to complete permanent repair or system restoration.

8.4 Explicit Exclusions

The Repair Benefit does not include, and BlueGuard shall have no responsibility for:

8.6 Independent Contractors

All repair services are performed by licensed independent third-party plumbing contractors. Such contractors are not employees, agents, or representatives of BlueGuard.

BlueGuard does not warrant or guarantee the workmanship, materials, or outcomes of any repair services.

8.7 Discretion and Termination of Work

BlueGuard reserves the right, in its sole discretion, to:

BlueGuard is not an insurance company, warranty provider, or home protection plan. Nothing in these Terms creates insurance coverage or guarantees against loss, damage, or plumbing system condition.

Nothing in these Terms limits consumer rights that cannot be waived under California law. Liability limitations apply only to the maximum extent permitted.

These Terms are governed by Texas law. Venue shall lie exclusively in courts located in the State of Texas.

Any provision found unenforceable under Florida law shall be severed, and the remaining Terms shall remain in full force and effect.

You may terminate the Services at any time. BlueGuard may suspend or terminate access for violation of these Terms or if required by law.

14. Changes to Terms

BlueGuard may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
